Welcome to SHDJXG (the "Service"). The Service is operated by SHDJXG ("we," "us," or "our") and is accessible at shdjxg.com. The Service is an independent editorial fragrance reference: documentation of perfume compositions, raw materials, wear behaviour, and a set of free interactive tools. The Service is provided for informational and editorial purposes only and does not sell any product.

1. Acceptance of Terms

These Terms of Service (these "Terms") govern your access to and use of the Service. By accessing, browsing, or otherwise using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not access or use the Service. Your continued use of the Service after any update to these Terms takes effect constitutes your acceptance of the revised Terms.

If you are accessing the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, in which case "you" refers to that organisation.

2. User Rules and Responsibilities

a. Eligibility. You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

b. Limited licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial, editorial reference purposes, subject to these Terms.

c. Account responsibility. Where the Service permits account creation, you are responsible for all activity that occurs under your account and for keeping your credentials secure. You agree to notify us immediately of any unauthorised use of your account.

d. Lawful use. You agree not to use the Service for any illegal or unauthorised purpose and to comply with all applicable laws, rules, and regulations. You must not interfere with, disrupt, or attempt to gain unauthorised access to the Service, its servers, or any networks connected to it, including by way of automated scraping, crawling, or rate-abuse beyond reasonable personal use.

e. Editorial integrity. You agree not to misrepresent, rebrand, or republish our editorial content or tool outputs as your own, and not to use the Service in a manner that could damage, disable, overload, or impair the Service.

3. Intellectual Property

The Service and its original content, features, functionality, editorial methodology, tool logic, and visual design are and will remain the exclusive property of SHDJXG and its licensors. All trademarks, service marks, trade names, and trade dress appearing on the Service are the property of SHDJXG or their respective owners and may not be used in connection with any product or service without the prior written consent of the owner.

Fragrance names, house names, and brand identifiers referenced in editorial content belong to their respective owners and are referenced for editorial and informational purposes only. SHDJXG is independent and is not affiliated with, endorsed by, or sponsored by any of the houses documented on the Service.

4. User Content

If the Service now or in the future permits you to post, link to, or otherwise make available any content ("User Content"), you grant SHDJXG a non-exclusive, worldwide, royalty-free, sub-licensable licence to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. You retain all of your rights to your User Content. You represent and warrant that your User Content is lawful, that you hold the rights necessary to grant the licence above, and that it does not infringe the rights of any third party.

5. Third-Party Links and References

The Service may contain links to third-party websites or services, and editorial references to third-party brands, retailers, or publications that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, accuracy, privacy practices, or availability of any third-party site or service. Any reliance you place on such third parties is strictly at your own risk.

6. Account Suspension and Termination

a. Termination by you. You may stop using the Service at any time. If you have created an account, you may request its deactivation or deletion by contacting us at [email protected]. Upon your request, we will deactivate the account and, where applicable, remove personally identifiable data associated with it in accordance with our Privacy Policy and applicable law.

b. Suspension by us. We may suspend, restrict, or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms, misuse the Service, or expose us or third parties to legal or reputational risk.

c. Effect of termination. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms which by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — shall survive termination.

7. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.

Editorial content, longevity ranges, season recommendations, and tool outputs on the Service reflect our independent editorial judgement and are not professional advice. Fragrance perception varies with skin chemistry, climate, and formulation changes. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any result obtained through a tool will be accurate or applicable to your individual circumstances.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall SHDJXG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service, (ii) any reliance on editorial content or tool output, or (iii) any unauthorised access to or alteration of your data.

Because the Service is provided free of charge and for editorial reference only, the aggregate liability of SHDJXG for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid to SHDJXG for the Service in the twelve months preceding the claim, or (b) USD 1.00. Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so the above exclusions and limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold SHDJXG harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to reasonable attorney's fees) arising out of or resulting from your use of or access to the Service, your User Content, or your breach of these Terms.

10. Dispute Resolution

a. Informal resolution first. In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute"), the parties shall first attempt in good faith to resolve the Dispute informally. The complaining party shall send a written notice of the Dispute to [email protected] describing the nature of the claim and the relief sought. The parties shall attempt to resolve the Dispute within sixty (60) days of such notice.

b. Arbitration. If the Dispute is not resolved informally within that period, the Dispute shall be finally resolved by binding arbitration administered in accordance with the rules of the arbitration institution agreed by the parties, or, in the absence of agreement, by a single arbitrator appointed under the law identified in Section 12. The seat of arbitration shall be the same as the governing law below. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

c. Exception for injunctive relief. Notwithstanding the above, either party may seek interim or injunctive relief from a court of competent jurisdiction to protect intellectual property rights or confidential information at any time.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the most recent revision by updating the "Last Updated" date at the top of this page and, where the changes are material, we will endeavour to provide at least thirty (30) days' notice before the new Terms take effect. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.

12. Governing Law and Jurisdiction

These Terms and any Dispute between you and SHDJXG shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to the dispute resolution provisions in Section 10, you and SHDJXG agree that the courts of the People's Republic of China shall have exclusive jurisdiction over any Dispute, and that the dispute shall be brought before the People's Court of competent jurisdiction at the place of SHDJXG's principal place of business. For the avoidance of doubt, this clause does not deprive consumers of any protection afforded by mandatory provisions of the law of the country in which they habitually reside.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between SHDJXG and you regarding the Service and supersede and replace any prior agreements or understandings, whether oral or written, between the parties regarding the Service.
